Terms and Conditions
These Terms and Conditions ("Terms") govern the provision of vehicle repair and related services by Kalum Bodywork ("we," "us," or "our") to you, the customer ("you" or "your"). By authorising us to commence work on your vehicle, you agree to be bound by these Terms.
1. The Repair Process Agreement
1.1 Authorisation: Your explicit written or verbal confirmation that you wish to proceed constitutes your acceptance of these Terms.
1.2 Standard of Service: We will carry out the repair service with reasonable care and skill. All parts and materials supplied will be of satisfactory quality, fit for purpose, and as described.
1.3 Additional Work: If, during the repair process, we discover additional damage or necessary repairs not included in the original estimate, we will notify you and/or your insurer immediately. We will only proceed with the additional work upon receiving explicit authorisation from you or your insurer.
1.4 Cancellation: You have the right to cancel the repair process by calling or sending an email up to 48 hours before delivery of the service.
2. Parts Used in Repair
2.1 Parts Quality: We endeavour to use genuine manufacturer parts. However, depending on your insurance policy or specific repair requirements, other parts may be used, which will be specified on your estimate. Any parts fitted will be of satisfactory quality and fit for purpose, meeting or exceeding manufacturer specifications.
2.2 Green Parts (Recycled/Used Parts): Where your insurer has specified or you have agreed to the use of "Green Parts" (recycled/used parts) as an environmentally conscious or cost-effective option, you agree to their fitment.
Quality: All Green Parts will be inspected and deemed fit for purpose by our certified technicians and/or the parts supplier.
Warranty: The warranty on Green Parts may be limited by the original supplier, and you will be informed of the specific terms that apply to those parts.
2.3 Backorder Parts: If any part required for your repair is on backorder from the supplier or manufacturer, this is considered a factor outside of our reasonable control.
Notification: We will inform you and/or your insurer immediately of any parts backorder and provide the best estimated time of arrival (ETA).
Liability: While we will take all reasonable steps to source parts quickly, Kalum Bodywork is not liable for delays to the repair completion date caused solely by parts backorders, supplier issues, or other factors outside our direct control.
3. Repair Times
3.1 Reasonable Time: The repair will be carried out within a reasonable time. Any completion date given is an estimate only, based on current workflow and available information.
3.2 Extensions: You acknowledge that the estimated repair time may be extended due to factors including, but not limited to: insurer authorisation delays, unforeseen additional damage, parts backorders (as per Clause 2.3), or force majeure.
3.3 Communication: We will communicate any significant, foreseeable delays to the repair completion date as soon as reasonably possible.
4. Courtesy Car
4.1 Availability: The provision of a courtesy car is subject to availability, your eligibility, and is granted under a separate written Courtesy Car Agreement, which must be signed by you.
4.2 Terms: You agree to abide by all conditions outlined in the separate Courtesy Car Agreement, including but not limited to: mileage limits, fuel policy, any insurance excess liability for damage, and the required date for return.
5. Total Loss (Write-Off)
5.1 Declaration: Should your vehicle be deemed a "Total Loss" (i.e., uneconomical to repair) by your insurer after assessment or strip-down, the repair process will immediately cease.
5.2 UK Write-Off Categories: You acknowledge the UK insurance write-off categories (A, B, S, N) and agree that we will follow the process mandated by your insurer and the relevant UK regulations for handling the vehicle, including the notification to the DVLA where necessary.
6. Payment
6.1 Required Payments: Upon collection of your vehicle, you are responsible for paying:
Insurance Excess: The compulsory or voluntary excess specified in your insurance policy.
VAT Liability: Any Value Added Tax (VAT) on the repair costs that your insurer does not cover.
Private Repairs: The full cost of repairs for non-insurance work.
6.2 Method: Payment must be made in full before the vehicle is released. We accept debit cards and bank transfers. We do not accept credit payments at this time.
6.3 Late Payment: We reserve the right to charge statutory interest on any outstanding amounts not paid upon collection of the vehicle.
6.4 Retention: We reserve the right to retain your vehicle until all agreed repair work is completed and all outstanding charges (including the excess, VAT, or private repair costs) are paid in full.
7. Disclosure and Data Protection
7.1 Vehicle Condition Disclosure: You must disclose to us any known pre-existing mechanical, electrical, or bodywork issues with the vehicle that may affect the repair process or its safe operation.
7.2 Data Protection: We will collect and process personal data (including vehicle registration number, contact details, and images of the damage) in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 (DPA).
Lawful Basis: We process your data primarily on the lawful basis of Contract (to complete your repair) and Legitimate Interests (for quality assurance, audit, and fraud prevention).

8. Changes to this Terms & Conditions
We may periodically update these Terms & Conditions to reflect changes in the law and our internal processes as needed.
IMPORTANT
Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms and Conditions. This includes the right for services to be carried out with reasonable care and skill, and within a reasonable time, and for goods supplied to be of satisfactory quality.
